What data is collected?
Only the data users provide voluntarily is processed, together with the technical data strictly required for the site to work.
- Contact form: name, email address, phone number with its international dialling code (optional field), type of service of interest and the content of the message.
- Direct communications: if users write via WhatsApp, email or Instagram, whatever data they choose to include in that communication.
- Technical data: the hosting provider logs the IP address and request data for a limited period, for security and for the operation of the service.
No special categories of data (article 9 GDPR) are requested. Please do not include health information in the contact form: should it be necessary in order to provide the service, it will be collected at the appropriate time along with the corresponding additional information.
What is it used for, and under what legal basis?
- To respond to the enquiry and assess the possible provision of the service. Legal basis: steps taken at the request of the data subject prior to entering into a contract (article 6.1.b GDPR) and consent of the data subject (article 6.1.a).
- To maintain the correspondence arising from that enquiry. Legal basis: consent of the data subject (article 6.1.a).
- To ensure the security and correct operation of the website. Legal basis: legitimate interest of the controller (article 6.1.f).
No marketing communications or newsletters are sent, and data will not be used for that purpose without the data subject's express and separate consent.
How long is it kept?
Enquiry data is kept for as long as necessary to deal with it and, where no service relationship begins, it is deleted within a maximum of one year from the last contact.
Where a service relationship does begin, data is kept for its duration and then blocked for the limitation periods of any applicable legal, tax and accounting obligations.
Who else sees your data?
Personal data is not disclosed to third parties, except where required by law. It is accessed by providers who deliver services to the controller as data processors, with whom the contract required by article 28 GDPR is signed.
- Website hosting provider: [TO BE CONFIRMED — add the provider's name and country before publishing].
- Email delivery provider for the contact form: [TO BE CONFIRMED — add once real delivery is connected].
If users choose to write via WhatsApp or Instagram, that communication takes place on the relevant platform and is governed by its own privacy policy, outside the controller's control.
Does your data leave Europe?
Processing is expected to take place within the European Economic Area. Should any provider involve an international transfer of data, this policy will be updated accordingly and the safeguards set out in chapter V of the GDPR will be applied, such as the standard contractual clauses approved by the European Commission.
What are your rights?
Users may exercise their rights of access, rectification, erasure, objection, restriction of processing and portability by writing to martinez.balance@gmail.com, stating the right they wish to exercise and enclosing a copy of a document proving their identity.
Where processing is based on consent, users may withdraw it at any time, without affecting the lawfulness of processing carried out before its withdrawal.
Users may also lodge a complaint with the Spanish Data Protection Agency (C/ Jorge Juan 6, 28001 Madrid — www.aepd.es), particularly if they consider that their rights have not been properly addressed.
Is any profiling done about you?
No automated decision-making or profiling is carried out with the data provided.
What if you are under age?
This website is not directed at children under fourteen. If data belonging to a child under that age is found to have been provided without the consent of those holding parental responsibility or guardianship, it will be deleted.
How is your data protected?
The controller applies appropriate technical and organisational measures to protect personal data. Communication between the browser and the website is encrypted using HTTPS.
Are cookies used?
This website uses no analytics, advertising, tracking or social media cookies, and loads no third-party resources: the typeface is served from our own domain and there are no embedded maps, videos or external scripts. That is why no cookie consent banner is shown: there is nothing to consent to.
A single first-party, technical cookie is used:
- Name
- · NEXT_LOCALE
- Owner
- · First party (martinezbalance.com)
- Purpose
- · To remember the language selected, Spanish or English, so the site is shown in the right language
- Duration
- · Session: the browser deletes it on closing
This is a user interface customisation cookie, exempt from the consent requirement under article 22.2 LSSI-CE. Users may block or delete it from their browser settings; the site will continue to work and will simply display the default language. Should analytics or third-party cookies be introduced in future, prior consent would be requested through the corresponding banner and this policy would be updated.
What happens if this policy changes?
This policy may be updated to reflect regulatory changes or changes to the services. The version in force will always be the one published on this page, showing its update date.
